What on earth is wrong with our judicial system?

An Idaho judge has ordered a 19-year-old man not to have sex with anyone before he marries as part of his sentencing for statutory rape of a 14-year-old girl.

Judge Randy Stoker sentenced Cody Duane Scott Herrera of Twin Falls to five to 15 years in prison, but he suspended the sentence for a one-year rider program. If the unmarried Herrera completes the program, he’ll be released on probation, which requires celibacy unless he weds. 

The mother of the victim was no pleased with the verdict, as she shouldn’t be. The mother stated that Herrera knew what he was doing and he took what he wanted form her daughter, her virginity. 

The judge created the whacked out probation stipulation after hearing Herrera has had 34 sex partners. For whatever reason, the judge felt it necessary to cut the jail sentence and try to keep Herrara from having intercourse. 

Shaakirrah R. Sanders, an associate professor at the University of Idaho College of Law, said the probation condition might be illegal or unenforceable.

“I think it infringes on his constitutional rights,” she said.

Sanders also believes if Herrera should appeal the courts decision, he would win. 

This man raped a 14-year-old…and this is his sentence??? What on earth is going on in Idaho?
