That ice cream joke that went viral a couple of months ago will probably never be repeated again, because as of July 4, police has confirmed that the woman in the video would most likely face a second-degree felony charge for tampering with a consumer product.
According to the Texas state penal, a charge like this carries two up to 20 years in prison and a fine up to $10,000. Investigators have been in discussion with the FDA over the federal charges that could be filed.
As of now, the female ice cream eater’s identity remains a mystery, but the police mentioned that they have finally identified her after ‘detectives had obtained surveillance video placing a woman matching the suspect description in the Lufkin store on June 28 around 11 p.m.’
Police are verifying her identity before they go along and issue a warrant of arrest, adding that there is also a man that is under investigation.

The police spokesperson told NBC News:
“Our detectives are working to verify the identity of the female suspect before a warrant is issued for her arrest on a charge of second-degree felony tampering with a consumer product.
As that portion of the investigation continues, detectives are focusing on identifying the male (in the green shirt) behind the camera seen in images of the two entering the store together.”

The ice cream brand that the woman licked is called Blue Bell Creameries, and they came out with a statement describing the incident as a ‘malicious act of food tampering.’ They also said that all tubs with the same ice cream flavor that was tampered with have been removed from the store as a precaution, so as to assure that the compromised tub is not confused with another of the same flavor.
Blue Bell Creameries assured their costumers that they would definitely notice any tampering when buying a fresh tub because its cartons are frozen upside down during production, which gives a natural seal on the lids.
