It would seem that despite the abuse that Melissa put the helpless toddler to, since she had no prior record, she could only be charged with a Class D felony in the state of Arkansas. And considering that the courts didn’t see any actual physical abuse marks on the child and were only going by the video, the judge allowed Melissa to plead guilty to endangering the welfare of a minor.
