The Democratic People’s Republic of Korea (DPRK or North Korea) has rules that they ask tourists to follow during their trip to North Korea. This picture is doubly illegal since tourists are not supposed to take picture of the military and tourists are also not supposed to take photographs of soldiers relaxing (smoking is a form of relaxation). In addition, the picture was taken without the permission of the subject, and most likely also without the permission of the tour guide. One of the rules of photography that the guide will tell you during the tour would be to ask to take photographs, since a tourist does not have the right to freely take pictures of the country and its people. If you keep taking unauthorized photographs, the government authorities of North Korea may consider this unauthorized picture taking as a form of espionage. The pictures that were taken will be deleted, and there is a chance that the device might be confiscated, but the worst possibility would be that the photographer could be detained.
